Southern Harvest (the company) has the following terms and conditions:
1. Warranty and Liability:
- The company warrants only the variety and quantity of seeds sold, within reasonable tolerances.
- The company excludes liability for any loss or damage arising from the use of their products or information.
2. Pricing and Payment:
- Prices are in Australian dollars, inclusive of GST where applicable.
- Payment must be cleared before goods are dispatched.
- For approved credit accounts, payment is due 30 days from invoice date.
3. Delivery and Returns:
- Delivery is typically via Australia Post or courier at the customer's expense.
- The company is not responsible for goods lost, stolen, or damaged during transit.
- Returns are subject to prior written agreement and may incur handling fees.
4. Order Cancellation:
- Orders can be cancelled only if the company hasn't incurred costs or prepared the goods.
5. Property and Risk:
- Title to goods remains with the supplier until full payment is received.
- Risk passes to the customer when goods leave the supplier's premises.
6. Quarantine and International Orders:
- Some products may be restricted due to quarantine regulations.
- Western Australia does have quarantine restrictions. Seed that is not permitted entry to WA is stated at the end of the description as 'Not to WA'. We aim to keep abreast of all the changes with WA Quarantine but purchasers should check on the permitted species list (see https://www.agric.wa.gov.au/bam/western-australian-organism-list-waol) for the latest information. From 1st July 2013 WA Quarantine will be charging an inspection fee for all seed imported into WA. The current fee can be found at https://www.agric.wa.gov.au/biosecurity-quarantine (invoiced by WA Quarantine direct to the purchaser, you are not charged at our end). Gardeners may wish to band together in order to share this cost. Permitted species can be found through a search function on this WA Quarantine site: https://www.agric.wa.gov.au/organisms
- International: We no longer send seed overseas due to the complexity or each countries.
7. Use of Seeds:
- Seeds are for propagation only, not for direct consumption.
- The company disclaims responsibility for crop results.
8. Seed Counts:
- Seed counts are approximate and provided as a guide only. Seeds are measured by volume or weight.
